Your agreement with us

By accessing or using OrthodontistNearMe, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Site on behalf of an orthodontic practice or other organization, you confirm that you have the authority to bind that practice or organization to these Terms.

If you do not agree to these Terms, you must not use the Site.

Who can use the site

OrthodontistNearMe is intended for users 18 years of age or older who are located in the United States. By using the Site, you confirm that you are at least 18 years old and that the information you provide is accurate.

If you are searching for orthodontic care for a minor child, you may use the Site as a parent or legal guardian acting on the minor’s behalf. The minor must not directly create an account or submit information through the Site.

Orthodontists and practices that create or claim listings must be currently licensed to practice in the United States.

Accounts

Certain features, such as claiming a listing or purchasing a premium listing, require an account. You are responsible for:

• Providing accurate and current information when you create your account
• Keeping your password confidential
• All activity that occurs under your account
• Notifying us promptly if you suspect unauthorized access

We may suspend or terminate accounts that contain false information, violate these Terms, or are used to abuse the Site.

Provider listings

Listing accuracy

Some listings on OrthodontistNearMe are created by us from publicly available information, including state dental board records, practice websites, and other public business listings. Other listings are submitted or claimed by the providers themselves. We work to keep listings accurate but cannot guarantee that every detail is current or complete.

Claiming a listing

If you are an orthodontist or authorized representative of a practice, you may claim your existing listing or submit a new one. By doing so, you confirm that:

• You are authorized to act on behalf of the practice
• The orthodontist named in the listing holds a current, valid license to practice in the United States
• The information you submit is accurate to the best of your knowledge
• You will update your listing if information changes materially

Ownership disclosure

OrthodontistNearMe is built around ownership transparency. Every listing is labeled as Privately Owned or Corporate Owned. By creating or claiming a listing, you agree that we may display this label based on the current legal ownership of the practice, and that you will respond truthfully if we ask you to confirm ownership status.

Our right to edit or remove listings

We reserve the right to edit, suspend, or remove any listing at our discretion, including listings that contain inaccurate information, violate these Terms, or are reported as misleading. We may also decline to display credentials that we cannot verify.

Paid listings and payments

Plans and pricing

Free listings are free forever. Premium listings are available for an annual fee of $49 per year, which is the price stated at the time of purchase. We may change pricing for future purchases, but existing premium listings will remain at the price you paid for the duration of the current annual term.

Activation timing

Free listings go live immediately after submission. Premium upgrades are typically activated within 1 to 2 weeks of payment confirmation, while we verify practice details. We will notify you when your premium listing is live.

Payment processing

All payments are processed by Stripe, our payment processor. We do not store full payment card details. By providing payment information, you authorize us to charge the amount of the selected plan to your payment method. Stripe’s terms and privacy policy apply to your payment activity in addition to these Terms.

Refund policy

Renewals

Premium listings do not automatically renew. At the end of your annual term, your listing will revert to a free listing unless you choose to renew. We will send a reminder before your term ends.

Disputed charges

If you believe a charge was made in error, please contact us first so we can investigate. Filing a chargeback with your payment card issuer before contacting us may result in the immediate termination of your account and removal of your listing.

Acceptable use

When using OrthodontistNearMe, you agree NOT to:

• Submit false, misleading, or fraudulent information, including fake reviews or unauthorized credentials
• Impersonate any person, practice, or entity
• Use the Site or its data to harass, defame, or harm any individual or practice
• Scrape, copy, or harvest listings, content, or data from the Site without our written permission
• Reverse engineer, decompile, or attempt to access the source code of the Site
• Use automated tools, bots, or scripts to access the Site, except for well-behaved search engine crawlers
• Interfere with or disrupt the Site, its servers, or its security
• Use the Site to violate any applicable law, regulation, or third party right
• Submit spam, malware, or content that contains viruses or harmful code

We may suspend or terminate your access to the Site at any time for violations of this section.

Our content and trademarks

The OrthodontistNearMe name, logo, design, written content, and overall presentation of the Site are owned by us and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute our content or trademarks without our prior written permission.

You are welcome to share links to public pages on the Site. You may not embed, scrape, or redistribute our listings or other content as if it were your own.

Content you submit

You retain ownership of any content you submit to the Site, including listing information, photos, descriptions, and messages. By submitting content, you grant OrthodontistNearMe a worldwide, royalty-free, non-exclusive license to display, reproduce, distribute, and modify that content as needed to operate the Site and promote it.

You confirm that you have all rights necessary to grant this license, including rights to any photos, logos, or text you submit, and that your content does not infringe on the rights of any third party.

Third-party services

The Site may link to third-party websites, such as practice websites, the American Board of Orthodontics, or social media platforms. We do not control these sites and are not responsible for their content, terms, or privacy practices. Visiting them is at your own risk.

We also use third-party services to operate the Site, including Google Analytics and Stripe. Your use of those services is subject to their respective terms and privacy policies.

Medical disclaimer

Information on the Site, including listings, credentials, and educational content, is provided for general informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified orthodontist or other licensed healthcare provider with any questions you may have about a medical or dental condition.

OrthodontistNearMe does not endorse, recommend, or vouch for any specific orthodontist, practice, or treatment. Listing on the Site is not an endorsement. Patients are responsible for independently evaluating any provider they consider, including verifying credentials, insurance acceptance, and current licensing.

In a medical or dental emergency, call 911 or seek immediate care from a qualified provider. Do not rely on the Site for emergency information.

Disclaimers and limitation of liability

Site provided “as is”

We do not warrant that listings are accurate, current, or complete. We do not warrant that credentials shown on listings are current. We do not warrant that any orthodontist on the Site is qualified or appropriate for your needs.

Limitation of liability

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of these limitations may not apply to you. In those cases, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless OrthodontistNearMe, its owners, employees, contractors, and affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising from or related to:

• Your use of the Site
• Your violation of these Terms
• Content you submit to the Site
• Your violation of any third party right, including intellectual property, privacy, or publicity rights
• Any dispute between you and an orthodontist or practice listed on the Site

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts.

Informal resolution first

Before filing any formal claim, you agree to first attempt to resolve the dispute by contacting us at hello@theorthodontistnearme.com. We will work in good faith to resolve the issue within 30 days.

No class actions

You agree that any dispute will be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.

Time limit

Any claim arising from or related to these Terms or the Site must be filed within one (1) year after the claim arises, or it is permanently barred.

Changes to these terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of the page. If the changes are material, we will provide additional notice, such as an email to registered users or a notice on the Site. Your continued use of the Site after a change means you accept the updated Terms.
